EEOC pulls Affirmative Action regulations
The Equal Employment Opportunity Commission has published in today's Federal Register a final interpretive rule to rescind its regulations regarding Affirmative Action Appropriate Under Title VII of the Civil Rights Act of 1964 ("Guidelines"), and removing them from the Code of Federal Regulations. The Commission is rescinding the Guidelines because the Guidelines are inconsistent with the statutory language and were not supported by Supreme Court precedent when issued; they are obsolete; they only apply to affirmative action to benefit women or minorities; and they do not take into account multiple relevant Supreme Court cases and numerous developments in the lower courts, over the past four decades since their issuance in 1979.

This final interpretive rule, which removes and reserves 29 CFR part 1608, became effective with today's publication and are applicable as of June 29, 2026.

ABA proposes rewrite of FCC's 'revoke all' rule
The ABA Banking Journal reports that the ABA has joined with the National Consumer Law Center (NCLC) and ACA International (ACA) in proposing that the Federal Communications Commission (FCC) rewrite its "revoke all" rule, which is set to take effect on January 31, 2027, but is currently under Commission reconsideration.

The ABA, NCLC, and ACA propose changes to allow a caller (a bank, for example) to interpret a revocation request as applying only to the category of messages to which the revocation was directed, while also requiring the caller to provide notice of how revocation will be construed and a means for the consumer to revoke consent with respect to all messages requiring consent. The revisions also allow a caller to designate a prescribed list of exclusive, reasonable means of revocation in the message sent to the called party.

OCC announces Deputy Comptroller for systems and analytical support
The Office of the Comptroller of the Currency (OCC) has announced the promotion of Jamie Wilds to Deputy Comptroller for Supervision System and Analytical Support (SSAS). In this role, Mr. Wilds will manage the administration, development, and enhancement of supervisory data, systems, reports and analytics, in support of supervision objectives and the agency's mission.
